Terms and Conditions

Payment Terms and Conditions – Panterra Eco Expeditions

These Terms and Conditions apply to all Expeditions and stays at Camp San Dionisio operated by Panterra Educational and Cultural Training Society DBA Panterra Eco Expeditions. (“Panterra”). They govern the contractual relationship between you (the “Client”) and Panterra with respect to any such Expedition.

By booking and participating in a Panterra Expedition, the Client confirms they have read, understood, and agreed to be bound by these Terms and Conditions.


1. Booking and Deposit

A non-refundable deposit is required at the time of booking to confirm participation in any Panterra Expedition or stay at Camp San Dionisio. Bookings are not confirmed until the deposit has been received and acknowledged by Panterra in writing.

If a booking is made 60 days or fewer prior to departure, full payment is required at the time of booking, unless otherwise approved at the sole discretion of Panterra.


2. Non-Refundable Deposit Policy

The deposit is non-refundable under all circumstances. However, should the minimum number of participants required to operate the Expedition not be met, the deposit will be fully refunded. In such cases, Clients will be notified prior to the final payment deadline.


3. Final Payment and Invoicing

Final payment is due 60 days prior to the Expedition departure date. Payment details and deadlines will be outlined in the confirmation invoice sent via email.

If full payment is not received by the due date:

  • Panterra reserves the right to adjust the rate for the Expedition; or
  • Treat the booking as cancelled, retaining the deposit as a cancellation fee at its sole discretion.

If any Expedition has payment terms differing from the above, such terms will be communicated prior to booking and reflected in the invoice.


4. Airfare Exclusions and Responsibility

Expedition prices do not include domestic or international airfare or flights unless explicitly stated in the itinerary inclusions.

Where air travel is included, Panterra acts only as a sales agent for the relevant airline. The airline’s terms and conditions will apply to all air ticket purchases, including cancellation policies and limitations of liability. Clients are advised to review the carrier’s conditions of carriage carefully.

Panterra is not responsible for changes to air itineraries, flight times, or associated consequences.


5. Payment Processing Fees

Panterra is not liable for any fees or charges imposed by third parties or financial institutions (e.g., credit card fees) related to payments for Expeditions. Such fees will not be refunded.


6. Cancellations and Refunds

Clients may cancel their booking by notifying Panterra via email, written notice, or through their booking agent, if applicable. The following cancellation fees apply:

  • (a) 60 days or more before departure:
    Deposit is non-refundable. However, if a suitable replacement participant is found, a full refund (minus a $150 USD cancellation fee) will be issued.
  • (b) 30 to 59 days before departure:
    Full amount is non-refundable. However, if a suitable replacement participant is found, a refund (minus a $250 USD cancellation fee) will be issued.
  • (c) 29 days or fewer before departure:
    All payments are non-refundable. No replacement participants will be accepted.

7. Travel Insurance Requirements

Travel insurance is mandatory for all Clients participating in a Panterra Expedition. At minimum, coverage must include:

  • Emergency medical
  • Evacuation
  • Repatriation

It is strongly recommended that Clients also purchase comprehensive trip cancellation insurance to protect their vacation investment in the event of unforeseen circumstances.

Bookings

8. Acceptance of Terms and Designated Contact

By confirming a booking on any Panterra Expedition—including bookings made on behalf of one or more additional participants—you acknowledge and agree to these Terms and Conditions on behalf of all individuals named in the booking, including minors and individuals with disabilities.

Participation in, or travel as part of, any Expedition constitutes full acceptance of these Terms and Conditions by all participants.

The individual who submits the booking shall be considered the primary contact person and assumes responsibility for all communications and financial obligations on behalf of the other participants included in the booking.

Physical Fitness

9. Client Responsibility and Medical Considerations

All Clients are solely responsible for evaluating their own suitability and capability to participate in the specific Panterra Expedition they have booked. This includes making an honest assessment of personal physical and mental fitness, and understanding the demands and risks associated with adventure travel.

Clients are strongly advised to consult with their physician prior to travel, particularly regarding:

  • Fitness for travel and participation in adventure activities

  • Required or recommended vaccinations

  • Medical precautions relevant to the region and nature of the trip

  • Any ongoing medical conditions or concerns that may impact participation

Panterra does not provide medical advice and makes no guarantees regarding the suitability of its Expeditions for individuals with specific health needs. Some Expeditions may not be appropriate for individuals with limited mobility, physical or cognitive disabilities, pregnancy, or other medical or mental health conditions.

It is the Client’s responsibility to ensure that they are physically and mentally fit for the activities involved and to determine whether the Expedition poses any health risks or logistical challenges based on their individual condition.

Panterra Expeditions often operate in remote or undeveloped regions, where medical facilities may be limited and may not meet the standards of the Client’s home country. Panterra makes no representations or warranties regarding the availability, quality, or standard of medical care or facilities in these areas.

While Panterra will make reasonable efforts to accommodate special requests—including dietary requirements, mobility needs, and accommodation preferences—such requests are not guaranteed and do not form part of the contractual agreement between the Client and Panterra. Panterra shall not be held liable for any inability to accommodate or fulfill such requests

Client Age

10. Client Age Requirements

Adult Clients
Clients who are 18 years of age or older on the date of first travel are considered adults.

Minor Clients
Clients who are under the age of 18 on the date of first travel are considered minors. All bookings involving minor Clients are subject to review and approval by Panterra.

Where applicable law, judgment, or decree requires the consent of a parent or legal guardian for a minor to travel, it is the responsibility of the accompanying adult Client to:

  • Obtain all necessary consents and approvals,

  • Ensure that both the adult and the minor comply with all legal requirements related to travel,

  • Confirm eligibility to enter and depart from Mexico.

Panterra assumes no responsibility for any costs, damages, or losses resulting from a Client’s failure to obtain the required permissions, documentation, or legal approvals.


11. Supervision of Minor Clients

On all Panterra Expeditions that include minor participants:

  • An adult Client aged 25 or older must accompany no more than two minor Clients.

  • Each adult traveling with a minor assumes joint and several responsibility for the conduct, wellbeing, and supervision of the minor(s) in their care.

  • The adult Client expressly agrees to these Terms and Conditions on behalf of the minor(s), including all acknowledgments of risk and limitations of liability.

Panterra does not provide childcare or supervisory services for minors. Neither Panterra nor its representatives shall be held responsible for chaperoning, monitoring, or otherwise assuming responsibility for any minor Client.

Insurance

12. Travel Insurance Requirements

All Clients acknowledge and agree that comprehensive travel insurance is mandatory for participation in any Panterra Expedition. At a minimum, insurance coverage must include:

  • Emergency medical coverage

  • Medical evacuation

  • Repatriation of remains

This coverage must be valid for all applicable travel dates and must take effect no later than the first day of the Expedition. Insurance must cover personal injury and emergency medical expenses throughout the duration of the trip.

Panterra strongly recommends that Clients extend their insurance coverage to include, but not be limited to:

  • Trip cancellation and interruption

  • Curtailment

  • Lost or delayed baggage

  • Travel delays

  • Other expenses arising from injury, illness, loss, or inconvenience

The cost of travel insurance is not included in the price of the Expedition. It is the Client’s responsibility to obtain adequate insurance at their own expense.

When purchasing insurance, Clients must inform their insurer of the nature of the trip, including any adventure or remote travel activities, to ensure that coverage is appropriate for the specific Expedition booked.

Panterra reserves the right to request proof of insurance prior to departure and may deny participation to any Client who fails to provide such documentation.

Prices and Surcharges

13. Price Increases and Reductions

In the event of a price increase beyond the control of Panterra that exceeds 10% of the total cost of the applicable Expedition, affected Clients will be notified in writing. Upon receipt of such notice, the Client may choose to:

(a) Cancel the affected booking without incurring any cancellation fees, or
(b) Accept the price increase and proceed with the booking under the revised cost.

Clients must notify Panterra of their decision within 14 days of receiving the price increase notice. Failure to respond within this period will be deemed as acceptance of the price adjustment, and the Client will be responsible for payment of the increased amount.

From time to time, Panterra may offer promotional or last-minute discounts on selected Expeditions. These reduced prices apply only to new bookings and are not available to Clients with existing confirmed bookings (defined as bookings for which Panterra has received payment of at least the required deposit).

 

Validity

14. Itineraries, Pricing, and Travel Details

All dates, itineraries, and prices published by Panterra—whether in brochures, Expedition Information Booklets, or on the Panterra website—are indicative only and subject to change. The price quoted at the time of booking will be the applicable price, subject to any surcharges permitted under these Terms and Conditions.

Panterra reserves the right to make changes, revisions, or amendments to any published information prior to the conclusion of a booking contract. Any such modifications shall be deemed incorporated into the contract as of the date they are made.

Due to the dynamic nature of travel, Clients acknowledge that they are responsible for staying informed of any updates to their Expedition. This includes reviewing the Panterra website at least 72 hours prior to departure to ensure they have the most up-to-date itinerary and travel information, as minor changes may occur after the booking has been confirmed.

Travel Documents

15. Travel Documentation

It is the sole responsibility of the Client to obtain, carry, and maintain valid travel documentation throughout the duration of the Expedition. This includes, but is not limited to:

  • A valid passport (with an expiration date at least six months beyond the final day of travel with Panterra)

  • Any visas, permits, or entry/exit documentation required for travel to and from Mexico, and

  • Any certificates (e.g., vaccination certificates) or insurance policies required for entry under applicable laws or health regulations.

The Client is fully responsible for ensuring that all required documents are accurate, complete, and obtained prior to the start of the Expedition. Panterra is not liable for any consequences, delays, or costs incurred due to missing, expired, or incorrect documentation.

By participating in a Panterra Expedition, the Client accepts full financial responsibility for any losses, penalties, or additional expenses resulting from their failure to secure and maintain the appropriate travel documentation.

Flexibility and Unused Services

16. Flexibility and Itinerary Changes

By booking an Expedition with Panterra, the Client acknowledges and accepts that adventure travel inherently requires flexibility, and agrees to reasonable changes or adjustments to the itinerary as deemed necessary by Panterra.

The Client understands that routes, schedules, activities, accommodations, and modes of transportation may be subject to modification without prior notice due to unforeseen or uncontrollable circumstances. Such circumstances may include, but are not limited to:

  • Mechanical issues or equipment failure

  • Illness or medical emergencies

  • Local incidents or disruptions

  • Flight delays or cancellations

  • Labor strikes

  • Political unrest or border restrictions

  • Severe weather conditions

  • Natural disasters or other force majeure events

Panterra shall not be held liable for any such changes or disruptions beyond its reasonable control and no compensation, refund, or discount will be provided for any itinerary adjustments resulting from these circumstances.

Additionally, Panterra will not be responsible for any missed or unused services due to the Client’s actions, including but not limited to:

  • Late arrival or failure to join the Expedition

  • Voluntary withdrawal from the Expedition

  • Dismissal from the Expedition due to breach of these Terms or inappropriate conduct

In such cases, no refunds or compensation will be provided for the unused portion of the trip.

Changes

17. Changes to Bookings

Changes by Panterra:
Panterra reserves the right to make reasonable modifications to the Expedition itinerary or arrangements as deemed necessary or advisable for operational, safety, or other legitimate reasons, at its sole discretion.

Changes by the Client:
Clients are responsible for providing accurate, current, and complete information when making a booking. Bookings are non-transferable to other Expeditions or individuals without the prior written consent of Panterra.

Optional Extras

8. Optional Extras

For the purposes of this section, Optional Extras refer to any activities, transportation, meals, or services not explicitly included in the Expedition description, itinerary, or price.

Clients acknowledge that any assistance provided by Panterra representatives in arranging, recommending, or booking Optional Extras is offered solely at the Client’s request. Panterra makes no representations or warranties regarding such services and expressly disclaims all liability arising from the Client’s participation in or use of Optional Extras, or from any information provided by Panterra representatives related to these services.

Accordingly, the Client hereby releases and holds harmless Panterra from any and all claims, damages, losses, inconveniences, injuries, or loss of enjoyment that may result from participation in or booking of Optional Extras.

Clients engaging in Optional Extras acknowledge and agree that any liability for loss, damage, personal injury, illness, death, emotional distress, psychological harm, or property damage rests solely with the third-party provider of the respective service or activity.

Force Majeure

19. Limitation of Liability and Force Majeure

Panterra shall not be liable to the Client for any death, bodily injury, illness, emotional distress, damage, delay, loss, detriment to person or property, or any direct or indirect financial costs incurred, nor for any failure to commence, perform, or complete any obligation owed to the Client when such issues arise from causes beyond Panterra’s reasonable control.

Such causes include, but are not limited to:

  • Acts of God (natural disasters)

  • War, armed conflict, or war-like operations

  • Mechanical breakdowns or failures

  • Terrorist acts or threats thereof

  • Civil unrest, riots, insurrections, or political disturbances

  • Labor disputes or strikes

  • Government actions or restrictions

  • Interference by authorities

  • Fire or extreme weather conditions

  • Any other unforeseeable events beyond the control of Panterra or its third-party service providers

All such events, whether individually or collectively, shall be considered “Force Majeure.”

Under such circumstances, Panterra shall be excused from performance of its obligations and shall not be held responsible for any resulting losses or damages.

Applicable Law

20. Governing Law and Jurisdiction

This Contract and these Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. All Clients agree to submit to the exclusive jurisdiction of the courts located in Edmonton, Alberta, Canada for the resolution of any disputes arising under or in connection with these Terms.

Privacy Policy

21. Privacy and Personal Information

Panterra collects personal information from Clients as necessary to process bookings and deliver the contracted Expedition. We are committed to safeguarding Client information and protecting your privacy.

The information we collect, use, and disclose is limited to what is reasonably required to provide the specific services and experiences included in your Expedition. Panterra may share your information with third-party suppliers and operators involved in delivering components of the Expedition, solely to facilitate the provision of these services.
